Adu Boahene, Wife sue AG, EOCO over GH¢200m bail

The High Court will soon deliver a ruling on the bail request filed by lawyers representing Kwabena Adu-Boahene, former Director-General of the National Signals Bureau (NSB), and his wife, Angela Adjei Boateng.

The couple remains in custody as they contest what their defense team calls “unjustifiably harsh” bail conditions set by prosecutors.

The case lists the Attorney-General and the Economic and Organised Crime Office (EOCO) as respondents.

Their lawyers argue that the GH¢120 million bail demand for Adu-Boahene and GH¢80 million for his wife are not only excessive but also appear designed to circumvent constitutional detention limits.

They claim the conditions effectively prolong their clients’ detention beyond the legally permitted 48-hour period without trial.

“The Respondents with a clear motive to incarcerate the Applicants beyond the 48-hour period as spelt out by the Constitution have imposed burdensome and unreasonable conditions on the Applicants as the precondition for their granting them bail.”

In their application, the lawyers argued that the authorities are infringing on their clients’ rights.

“The justification of the bail is at the pleasure of the Respondents,” they stated, calling the move a blatant violation of their clients’ right to liberty. They further accused the state of denying them proper legal counsel and obstructing due process.
